the Customer can use the product within. The dimensions and other
physical characteristics are subject to normal commercial tolerances.
The Customer has the responsibility to determine, in advance, the
suitability of the product for the desired use.
Where the supplier
gives evidence or descriptive statements of the product, Drass
Galeazzi SrlU will follow the same arguments deeming them to conform
to current regulations without assuming any responsibility for
errors, omissions or violations of law. Drass Galeazzi SrlU reserves
the right to discontinue offering any product or make changes to
product specifications at any time without notice and without
providing justification for this decision.
Prices
The
prices of the products presented on the website are expressed in EUR
and do not include VAT. At the end of the purchasing process, before
the final acceptance by the client and before the payment, the
Customer will see the exact price of purchasing order, VAT and
delivery costs included except for the goods subject to Pre-Orders.
Any order placed by means of the website DiveHive.com has contractual value. The validity of the prices is mentioned on the
website DiveHive.com. In the
absence of a mention, the prices can be changed anytime. Furthermore,
the prices can vary daily, depending on the exchange rate changes
announced by European/Italian Bank Where prices are not explicitly
mentioned, the Customer may send a request of quotation to Drass
Galeazzi SrlU by e-mail, and after proceed with the purchase without
using the e-commerce site. Requested quotations will be valid for a
maximum period of 30 days unless otherwise agreed in a written notice
between the parties. If the 30-day period has expired, Drass Galeazzi
SrlU will no longer be bound by the issued offer.
Order
of the Products
To purchase the Product, Customers shall follow
the instructions given on the website. The Customer must place the
Product in the specific “shopping cart” and, after taking note of
the General Conditions, particularly regarding the contribution for
delivery expenses and procedures for exercising right to recession
and likewise the Privacy Policy, shall select the chosen terms of
payment and confirm Order option.
The Customer may correct any
errors in entering the data before confirming the Order. In
particular, the Customer can change the quantity of Products he/she
intends to purchase, adding or eliminating one or more Products from
the “shopping cart”.
In placing the Order the Customer
acknowledges and states to have taken note of the information
provided for Customers during the purchase. The Customer will be able
to view and follow up the status of the Purchase Order in the section
“My account”.
Drass Galeazzi SrlU cannot guarantee the
availability of all the presented products in stock at any moment.
Drass Galeazzi SrlU will inform the Customer about the unavailability
of the products; any amount paid in advance by any buyer – without
receiving a confirmation of the order, or in case cannot honor the
confirmed order will be reimbursed by Drass Galeazzi SrlU not later
than 7 days from the payment.
With Customer’s consent, Drass
Galeazzi SrlU can deliver a similar product or service, with an equal
quality and price to those initially requested, in case of
unavailability of the ordered product or service.
Payment
for the Products
The payment for the products ordered under these
Terms and Conditions may be effected only in advance.
The payment
in advance can be made by using the transfer devices following
payment instructions in the user’s guide section of the website.
The orders will be processed only after Advance payment receipt.
In
case the amount paid in advance is higher than the value of the
ordered products, the difference will be immediately returned to the
Customer.
If the amount paid in advance is lower than the value of
the ordered products, the client will have to pay the difference
before the start of order processing.
Product
Delivery
Only one delivery address will be accepted for each
order. The delivery will be made to the address that the client has
specified in the order. Delivery shall be taken and signed by an
adult over 18 years of age. No deliveries will be made to P.O.
Boxes.
Upon delivery of goods by the Courier, the Customer shall
check correspondence of the number of parcels being delivered with
the information given in the waybill and if the parcel is unharmed
and in sound condition. Any damages to the parcel and/or Products or
non-correspondence of number of parcels shall be immediately
contested by writing with reserve on the Courier’s note of
delivery. The Customer may not lay any claims as to the outside
appearance and the delivered parcel once the Courier’s document has
been signed.
Drass Galeazzi SrlU reserves the right to delay or
cancel deliveries of the ordered products if they can’t be honored
due to reasons independent on Drass Galeazzi SrlU including
unavailability of the manufacturer, governmental actions, force
majeure impediments, wars, acts of terrorism, protests, rebellions,
civil unrest, fire, explosion, floods, epidemics, strikes, etc.
In
case the client cannot be found at the specified address, our courier
will do another try to deliver, then the order will be returned and
the consumer will bear the costs of new quests, regardless of the
value of the ordered products.
Drass Galeazzi SrlU will be free
from financial commitments for parcels left in storage at the
Courier’s. Customers unable to make arrangements for another
delivery or to collect the parcel from the Courier premises will take
the responsibility of completing the delivery. Should the Courier
return the parcel to Drass Galeazzi SrlU owing to Customer’s
failure to collect the parcel, the Customer will be contacted by
Drass Galeazzi SrlU for possible re-delivery with refund request of
any storage expenses as well as delivery expenses born (re-delivery
to Drass Galeazzi SrlU) or to be born (re-delivery to Customer).
Should it not be in the intentions of the Customer to fulfil
commitments of payment against expenses born by Drass Galeazzi SrlU
or should the latter fail to get in touch to make arrangements or
fail to respond to the e-mail from Drass Galeazzi SrlU with request
to refund expenses born, within a reasonable period of time of 7
(seven) days, then Drass Galeazzi SrlU will keep the uncollected
goods due to default of the Customer.
Drass Galeazzi SrlU reserves
the right to cancel an order if the price of the product or some
product features were not correctly entered in the database, or
displayed incorrectly, if the delivery has not been performed
yet.
Casual delays may occur if problems show up on courier’s
route (floods, snow, etc.) or if the delivery is on a route outside
the coverage area of the courier. There are no deliveries on
Saturdays and Sundays.
Delivery times are indicative and in no
event will Drass Galeazzi SrlU be obliged to pay damages for late
delivery.
Return Policy
The
Customer shall thoroughly inspect the received goods upon receipt and
notify Drass Galeazzi SrlU in detail if any defect is found within 2
days. The notification must be made in writing to DiveHive.com
In
case the Customer fails to make such a notice, the goods will be
considered accepted and compliant with the order requirements. If the
complaint is unfounded, the Customer shall compensate Drass Galeazzi
SrlU all the expenses incurred in the investigation.
In case of
delivery of defective goods the material as well as the shipping
carton shall be taken. Drass Galeazzi Srlu shall be immediately
notified in the way and time as mentioned above. All products
packaging, padding and paperwork must be retained to ensure any
damaged shipment claims. If the original packaging padding and
paperwork are not retained the buyer will assume full responsibility
for damages. Do not return damaged or broked merchandise to Drass
Galeazzi SrlU unless you receive a return authorization. Drass
Galeazzi SrlU will be bound to repair or replace the goods or refund
the amount already paid.
Right
of Withdrawal
Drass Galeazzi SrlU respects the rights conferred by
law to the Consumer, these being unaffected by the offered warranty.
In the legal sense, Consumer refers to any physical or legal person
who uses a product outside its commercial activity, industrial or
handicraft production or profession. Any Consumer benefits of the
same rights and guarantees associated to the products sold.
The
deadline for withdrawal shall be fourteen (14) days from the date on
which the Consumer or a third party appointed by the Consumer, who is
not the carrier, takes possession of the final goods delivered
according to Regulation no 21/2014. The Consumer can exercise his
statutory right, referring to the legal regime of distance contracts,
only in written, and can return the product (products) only if it
is/they are in perfect condition, including the package, accessories
and the related supplies, if they don’t show any form or signs of
wear and consumption.

by sending a notice by registered mail with return receipt to:

In
the Withdrawal notice the Customer shall state his/her intention to
withdraw from the purchase and the Product(s) for which he/she
intends to exercise the Right of Withdrawal, and shall enclose copies
of the purchase invoice. In the notice, the Customer shall also
confirm that the Product(s) is/are intact and stored in perfect
condition in the original package, complete in all its/their parts.
Products must be returned, within 30 (thirty) calendar days after
receipt thereof.
In any event, the Right of Withdrawal is subject
to the following conditions:
the right applies to each individual product purchased as a whole;
the purchased Product(s) must be undamaged and must be returned in its original package, complete in all its parts (including outer packaging accessory documentation);
return Shipping Costs are at the Customer’s expense;
all responsibility for Product return rests with the Customer.
If
the Right of Withdrawal has been exercised correctly, Drass Galeazzi
SrlU shall refund to the Customer the full amount paid including
Shipping Costs within 30 (thirty) calendar days after receiving the
Withdrawal notice. Product Return costs shall be deduced from the
refund amount and shall remain at the Customer’s expense.
Drass
Galeazzi SrlU reserves the right at its sole discretion, to apply
more restrictive conditions to some particular products or consider
them to be excluded from the right of return. These goods are the
ones which consist of software or that have been made on Customer
request. These types of products will be from time to time specified
by Drass Galeazzi SrlU when ordering.
Product
Warranty
Consumers, as defined above, have the right to obtain the
legal warranty that shall be effective for a maximum period of 12
(twelve) months after Product delivery. After this period Drass
Galeazzi SrlU shall not be liable for any conformity defects
identified by the Consumer.
In case of Product replacement or
repair, the warranty expiry date applicable to the replaced or
repaired Product is the same as for the original Product. This means
that the one-year legal warranty period shall start from the date the
original product was delivered.

Customer. The products or parts returned must be accompanied by a
note stating the return authorization number (notified from Drass
Galeazzi SrlU when contacted from the Customer), the account number,

Order
Cancellation
Drass Galeazzi SrlU reserves the right to refuse or
cancel any order, regardless of whether the payment has been received
or not, giving notice to the Customer via e-mail within 48 hours from
receipt of order, weekends and public holidays excluded. If Drass
Galeazzi SrlU does not accept, or cancel an order that has already
been paid for, Drass Galeazzi SrlU will refund the entire received
amount in the way specified by the Customer. The reimbursement of the
price in case of non-acceptance or cancellation of the order is the
responsibility of Drass Galeazzi SrlU.
Disputes
Any
dispute regarding the use of this website will be solved amicably. In
case the conflict could not be settled amicably, it is of court’s
competence.
